GENERAL TERMS AND CONDITIONS OF SALE

Seasonal Rental – Furnished Tourist Accommodation

 

1. Purpose

These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the booking and seasonal rental of a furnished accommodation offered on the owner’s website (hereinafter the “Accommodation”), for exclusively tourist and temporary purposes.
Any booking implies full and unconditional acceptance of these GTC, as well as the mandatory electronic signature of a seasonal rental agreement sent electronically.

2. Contractual Documents and Legal Value

The contractual relationship consists of the following documents, in order of priority:

  1. The electronically signed seasonal rental agreement

  2. These GTC

  3. The house rules of the accommodation

A booking shall be considered final only after:

  • Booking confirmation

  • Payment in accordance with the specified terms

  • Electronic signature of the rental agreement

The electronic signature has the same legal value as a handwritten signature.

3. Temporary Nature of the Rental – No Right to Remain

The rental is granted on a strictly temporary basis, for a fixed period, excluding any use as a primary or secondary residence.
The tenant expressly acknowledges that they:

  • Have no right to remain in the accommodation

  • Undertake to vacate the accommodation on the agreed date and time

  • Waive any reclassification of the stay

Any refusal to vacate the premises entitles the owner to initiate any appropriate legal proceedings, at the tenant’s sole expense.

4. Maximum Occupancy

The accommodation is intended to host a maximum number of guests as defined at the time of booking.
Any additional person, whether declared or not, is strictly prohibited without prior written consent.
Any breach may result in immediate termination of the contract without refund.

5. Dynamic Pricing

Displayed rates are variable, non-fixed, and may be modified at any time, including from one day to the next, depending on the period, demand, local events, or commercial strategy.
The applicable rate is the one in effect at the time of final booking confirmation.
No claim may be made in the event of subsequent price changes.

6. Booking, Payment, and Fraud

A booking becomes binding only after payment and signature of the contract.
The owner reserves the right to:

  • Request a valid form of identification

  • Cancel, without refund, any booking based on inaccurate or fraudulent information

  • Refuse access to the accommodation in case of non-compliance

 

7. Security Deposit

A security deposit may be required prior to arrival.
It covers, in particular:

  • Damage

  • Excessive cleaning

  • Disturbances

  • Intervention costs

  • Fines or repairs attributable to the tenant

 

8. Check-in and Check-out

Self check-in: from 4:00 p.m.
Check-out: no later than 11:00 a.m.

Any unauthorized late departure may result in additional charges or penalties.

9. Strict Prohibition of Parties and Penalty Clause

Any party, event, gathering, celebration, or similar activity is strictly prohibited.
In the event of non-compliance, the owner reserves the right to:

  • Immediately terminate the contract without refund

  • Apply a fixed contractual penalty

  • Retain all or part of the security deposit

  • Invoice any related costs (security, cleaning, authorities, neighborhood issues)

 

10. Noise Disturbances and Monitoring Device

The accommodation is equipped with a noise disturbance detection device, in compliance with applicable legislation.
This device:

  • Does not capture or record any conversations or audio data

  • Measures only sound levels (decibels)

  • Complies with GDPR and privacy protection regulations

Any excessive noise may result in intervention or immediate termination.

11. Use of the Accommodation

The tenant agrees to:

  • Use the accommodation peacefully

  • Respect the neighborhood

  • Keep the accommodation in good condition

  • Comply with the house rules

The accommodation is non-smoking unless otherwise stated.

12. Damage and Liability

The tenant is responsible for:

  • Damage caused to the accommodation

  • Damage caused to third parties (neighbors, condominium, etc.)

It is recommended that the tenant holds holiday rental civil liability insurance covering the duration of the stay.

13. Neighborhood, Authorities, and Interventions

Any complaint or intervention by authorities, property management, or third parties attributable to the tenant may result in:

  • Immediate termination of the stay

  • Full invoicing of incurred costs

  • Retention of the security deposit

 

14. Children, Minors, and Safety

Any minors present in the accommodation remain under the sole responsibility of the accompanying adults.
The owner declines all liability in the event of an accident.

15. Cleaning and Check-out Condition

End-of-stay cleaning is included for normal use of the accommodation.
Excessive cleaning, abnormal condition of the accommodation, or unremoved waste may be charged.

16. Breakdowns, Service Interruptions, and Force Majeure

No compensation may be claimed in the event of:

  • A breakdown beyond the owner’s control

  • Service interruptions

  • Administrative decisions or force majeure events

 

17. Applicable Law and Disputes

These GTC and the rental agreement are governed by French law.
In the event of a dispute, an amicable solution shall be sought prior to any legal action.
